Expedite Privilege Logs
A privilege log displays all documents in a particular production that have been marked as responsive and privileged, including documents that are subject to attorney-client privilege or documents that are attorney work product. The purpose of the log is to report on these responsive documents without revealing privileged information. Because creating a privilege log can be one of the most expensive parts of the review, replacing manual efforts that can be inconsistent and time-consuming with technical options can increase accuracy, save time, and reduce the possibility of over or under-redacting or withholding.
Using MA to Expedite Privilege Logs
The below workflow represents a workflow that incorporates H5MA's Privilege Analytics and Name Normalization to generate outputs that can be directly incorporated into the creation of the privilege log.
The key elements helpful in expediting the creation of a Privilege Log are the following fields of information generated by H5MA:
- MA Normalized Name fields are populated with top-level or sub-level normalized name values for communicators, including their corresponding Function
- MA Normalized Name Function fields are populated with the corresponding Function (e.g. In-House Counsel, Outside Counsel, Client) for each communicator in a message
- MA PotPriv AutoReason field are automated Privilege Reasons generated from the Privilege Analytics process
These auto-generated fields can reduce the effort of generating these values manually, which can be time-consuming and tedious work. They can then be incorporated into the privilege log, along with privilege coding fields and document metadata fields, to develop the finished log for export and ultimate production.
